Abstract: The marketing of landed houses that are not yet physically visible even before the foundation pillars are formed is carried out using the Binding Sale and Purchase Agreement mechanism, which often violates consumer rights in Law Number 8 of 1999 concerning Consumer Protection because of the clauses in the Binding Agreement Buying and selling is more profitable for developers. This research examines whether the marketing system for landed houses being built by developers based on sales and purchase agreements can provide legal certainty for buyers. This research was conducted using normative research methods which focus on statutory regulations related to guaranteeing legal certainty in the marketing of landed houses as well as literature reviews related to the problems studied. The results of the research show that the mechanism for buying and selling landed houses being built by developers based on a sale and purchase agreement does not provide a guarantee of legal certainty for consumers when there is no monitoring of housing development of at least 20% and there is no monitoring that the Housing Development Acceleration Agency has provided a guarantee of development of housing. Landed house. The legal position of buyers of landed houses after handover is unclear because the sale and purchase deed does not yet exist. Landed house buyers only have a binding sale and purchase agreement which cannot be used as a basis for issuing a certificate.
