THE RIGHT TO RECALL LEGISLATIVE MEMBERS BY POLITICAL PARTIES: A CONSTITUTIONL IDEA

Abstract: This study aims to determine the arrangement of "Recall" DPR-RI members by political parties and the mechanism for replacing DPR-RI members who are recalled by political parties. The results of the study show that the recall rights of political parties to members of the DPR-RI are regulated in Law Number 17 of 2014 concerning the People's Consultative Assembly. This article discusses the recall rights of political parties to DPR members from the perspective of maslahah mursalah. The results of the study show that the right to recall political parties is regulated in Law Number 17 of 2014 concerning the MPR, DPR, DPD and DPRD. This article discusses the constituent recall and public recall as an idea to strengthen people's sovereignty in dismissing DPR and DPRD members. The results of the research show that the constitution and laws and regulations in Indonesia have not regulated the dismissal of members of the DPR and DPRD by voters (the people) after they are appointed as people's representatives. This study aims to analyze the recall rights of political parties in the Indonesian constitutional system. The results of the study show that the right to recall political parties is regulated in Law Number 17 of 2014 concerning the MPR, DPR, DPD and DPRD. From the search results, it can be concluded that the recall rights of political parties to DPR members are regulated in Law Number 17 of 2014 concerning the MPR, DPR, DPD and DPRD. However, the constitution and laws and regulations in Indonesia have not regulated the dismissal of members of the DPR and DPRD by voters (the people) after they are appointed as representatives of the people. The idea of constituent recall and public recall is considered as an effort to strengthen people's sovereignty in dismissing DPR and DPRD members.
